Compliance Advisor will help you determine compliance requirements for your products under the Consumer Product Safety Improvement Act (CPSIA) and the Lacey Act. The tool emphasizes important product testing, certification and regulatory requirements as published by the Consumer Product Safety Commission (CPSC) and the requirements and associated forms for USDA Lacey Act Compliance. Compliance Advisor users are encouraged to reference the CPSC website at www.cpsc.gov to review updates and recent activities by the USDA Animal and Plant Health Inspection Service (APHIS) as well at www.aphis.usda.gov.

Compliance Advisor: Lacey Act Definitions

Lacey Act Definitions

Common cultivar - A plant (except a tree) that:

  1. Has been developed through selective breeding or other means for specific morphological or physiological characteristics; and
  2. Is a species or hybrid that is cultivated on a commercial scale; and
  3. Is not listed:
    1. In an appendix to the Convention on International Trade in Endangered Species of Wild Fauna and Flora (27 UST 1087; TIAS 8249);
    2. As an endangered or threatened species under the Endangered Species Act of 1973 (16 U.S.C. 1531 et seq.); or
    3. Pursuant to any State law that provides for the conservation of species that are indigenous to the State and are threatened with extinction.

Common food crop - A plant that:

  1. Has been raised, grown, or cultivated for human or animal consumption; and
  2. Is a species or hybrid that is cultivated on a commercial scale; and
  3. Is not listed:
    1. In an appendix to the Convention on International Trade in Endangered Species of Wild Fauna and Flora (27 UST 1087; TIAS 8249);
    2. As an endangered or threatened species under the Endangered Species Act of 1973 (16 U.S.C. 1531 et seq.); or
    3. Pursuant to any State law that provides for the conservation of species that are indigenous to the State and are threatened with extinction.

Plant - Any wild member of the plant kingdom, including roots, seeds, parts or products thereof, and including trees from either natural or planted forest stands.

Tree - Any large, long-lived, perennial, compartmented, woody, shedding, walling plant as defined by the United States Department of Agriculture Forest Service

Packing Material - Any material used exclusively to support, protect, or carry another item. Packaging material includes manuals, tags, labels and warranty cards.
